Terms and Conditions of Service
Unity Sport Club (USC), registered at 48 Birmingham Rd, Bromsgrove, Worcestershire, B61 0DD
This Agreement is governed by and shall be construed in accordance with the laws of England.
DEFINITIONS

"US" refers to the company or the person with whom you have entered this agreement.

“Session” refers to the USC children’s sports programmes, products and services.

“Enrolment / Booking Form” refers to the form relating to the enrolment or reenrolment of a child on a USC class.

“Fee” refers to the monetary cost of pay & play per course as specified in the enrolment / booking form.
-
"Membership" refers to the monetary monthly membership programme.
-
“Coach” refers to the individual(s) employed by USC to teach the course. Every effort will be ensued to ensure that the coaching personnel for each venue remain the same, however, USC retain the right to change coaching personnel when required.

"Young Leader" refers to the graduate coach, USC are mentoring and supporting.

“Premises” refers to the premises where the course takes place.

“Child” refers to the child attending the course, whose details are specified by the Parent on the enrolment form.

“Terms” refers to the terms and conditions set out in this document and any special terms and conditions agreed in writing by USC and the Parent.

“Parent" refers to a parent and or carer, legal guardian who will be responsible for the payment of the fees and who is the contracting party in this contract. “Unity Sport Club (USC)
Acceptance of Terms and Conditions

All agreements relating to the teaching of the Session by USC to the Child are subject to these Terms to the exclusion of all other terms and conditions

No variation or addition to the Terms shall be binding unless agreed in writing by USC and the Parent

The Terms shall be deemed to have been accepted by the Parent upon payment of the Fee by or on behalf of the Parent and/or carer.

The Parent agrees to keep the content of the USC class confidential and not copy or use any aspect of the USC Programme directly or indirectly.
Payment
-
The Parent shall pay the whole Fee to USC prior to the Child commencing the selected course / event / class or session.

The Fee is non-refundable if activities are undertaken and without the prior written agreement of USC.

As a non for profit organisation , the monthly packages and pay & play fees pay for the hiring of the venue, coaching and associated equipment and overheads required to maintain the activity.

USC operates the highest levels of coach child ratios and therefore places are limited and the monthly subscriptions reserves a place whether the child attends the class or not.

Monthly subscriptions and pay per play fee for classes and camps are subject to change reflecting increases in venue, coaching and costs associated with legal compliance, requirements and government regulation.

Monthly subscription fees are recurring. Single child or sibling memberships are recurring payments are charged at the indicated rate on the payment page (this varies depending on the location and class attended).
Cancellation

USC reserves the right to cancel a class at any time before the child commences the course for any reason whatsoever. We will only cancel due to circumstances beyond our control and limit these where possible. In the event of cancellation by “acts of God” or cancellations enforced by venues due to public holidays, where we are unable to issue refunds.

USC shall not be liable for any loss or damage whatsoever arising from such cancellation.

The child monthly membership or pay & play for skills classes (football, dance, rugby, cricket tennis, golf and other sports and activities) secures the child's place in the class and the subscription will continue to be collected until USC receive notification via email (info@unitysportclub.com) from the Parent to cancel the membership.

Any refund due to lack of attendance is at the discretion of USC.

The Parent must ensure they give at least four weeks notice before the next renewal date. Please note, we are unable to issue any refunds if a cancellation request is made within four weeks of the renewal date and the renewal is subsequently collected.

For Trial bookings, in the event you wish to cancel following your Trial, please notify us via email (info@unitysportclub.com) within two days following the Trial date. Once this date has passed, we will require at least two weeks notice before the next payment date to cancel the subscription.

For bookings we do not accept childcare vouchers or government tax free childcare as a form of payment, any refunds, credit or movement of sessions are according to the notice periods outlined above.
Parental Responsibility
The Parent warrants and represents that:

The information set out in the enrolment / booking form (whether or not completed and/or signed by the Parent is accurate in all respects and the Parent will notify USC of any change in such information immediately.

The Parent will provide all relevant medical health and similar information required to conduct the Service and for the protection of the individual Child and other Childs and third parties and emergency services that may come into contact with the Child during the execution of the Service.

The Parent has read the USC Data Protection and Privacy Statement and has been informed as to their data and privacy rights as well as their personal data, its uses and processing of personal data by USC.

The Parent recognises USC legitimate right to use personal data in the normal course of conducting its business, for the execution of the service and the USC contractual obligations.

The Parent recognises the USC duty and responsibility to comply with its legal responsibilities, for compliance and governmental regulation with regard to personal data.

When attending the session / event / class, the Child will not be suffering from any illness, disease or anything similar thereto.

Where the Parent is present during the course of the Service, the Parent acknowledges and agrees that the Child shall be deemed to be under the direction, care and control of the Parent throughout the session and the Parent shall be responsible for the welfare and conduct of the Child throughout the Session and whilst the Child is on the Premises.

The Parent recognises that it is the core mission and essence of USC to promote healthy activity, sports, fitness, good behaviour and wellbeing for children and parents and that the use of marketing, communications, education, training and social media play a key element of promoting children’s sports and for the greater good of the community and the individual.

Where a child is a Ward of Court, the Parent has a responsibility to inform USC of such status and any associated information regarding the child and circumstances around such status as it pertains to the delivery of the service and data protection and privacy responsibilities of USC.

The Parent shall indemnify and keep indemnified USC against the loss (including loss of profit), liability, costs and expenses which USC shall incur directly or indirectly as a consequence of any action or inaction of the Parent, or the Child.

The Parent shall be responsible for any damage caused by the Child to any third-party property or individuals unless due to the direct act to cause any damage and the negligence of USC staff or sub-contractors.

We actively discourage the use of mobile phones for all events, sessions and courses and we request children do not bring them. Should they choose to bring, they are responsible for any loss of phones / personal equipment and any phone found being used in class will be removed and returned after the class.
Code of conduct

Coaches, parents and players need to respect each other. So, being aware of and managing unacceptable behaviour from players, spectators, and parents/carers is essential.

We have implemented our USC code of conduct as part of our programme and is essential aspect of a club’s safeguarding and player welfare framework. The code clearly spells out what’s acceptable behaviour and the consequences for unacceptable behaviour. USC adopt the code by having members sign up to it.

The code is like a club's roadmap. It outlines expected behaviours and details what happens when an individual’s conduct breaks the code.

Privacy & Data Protection

The Parent recognises that USC takes seriously its obligations and responsibilities and commitments under as defined by Data Protection legislation and common law rights of individuals pertaining to privacy and data protection rights. USC will obtain, retain and only process personal data in line with the UK Data Protection Act and the EU General Data Protection Regulation 2016 as well as respecting individual privacy and data protections rights within common law.

USC will only process data that is appropriate for the purposes of delivering services to members and as required by government regulatory bodies including OFSTED for the purposes intended to support parents, children over the lifetime membership and the full range of products and services provided by USC including sessions over the course of a Membership to USC.

USC will not store credit or debit card details.

USC will not share customer data with any 3rd parties other than for the purposes of executing USC contractual obligations to deliver the service and to comply with The FA and government regulation, emergency services, other governing sports bodies, protection of the individual and the legitimate interests of society at large including research and analysis.

Where there are events, tournaments, representative teams, competitive matches, training courses or classes, group travel or functions it may be necessary to share relevant communication information to the group including emails, mobile numbers and social media tags for the purposes of peer group support, safety, protection and for use during emergencies and situations where communications is needed between Children, Parents and Carers for the protection of children and for the legitimate interest of the group and the community.
Photography

At training sessions, events, classes, social and sports festivals, USC will be recording with photography and video for the purposes of training, quality and marketing purposes.

This will include group photos and action shots as well as training routines, team and squad pictures.

The parent acknowledges and confirms that you waiver any and all image rights and recognize that all image rights fully vest in USC during the membership application process.
Ownership and Return of Kit and Equipment Policy
Ownership:

All football kit, equipment, and related items provided to players, coaches, and staff members remain the property of the club.

The club retains full ownership rights over shirts/tops, shorts, socks, training and or matchday equipment, boots, balls, and any other items issued to individuals associated with the club.

All kits will be issued after three continuous months membership payments and will be for only those on the 360 membership package. USC reserve the right to not issue or extend the time period at our discretion.

USC reserve the right to issue kit pack at our discretion, to support the programme, marketing or company at any time to a paying member of the programme.

All pay & play bookings will not include a kit pack, however, they can be purchased individually from our club shop.
Responsibility:

Individuals receiving club kit and equipment are responsible for its proper care, maintenance, and safekeeping.

Any loss, damage, or unauthorized use of club gear will be subject to replacement costs or disciplinary action.
Return Upon Cancellation:

In the event of contract termination, resignation, or any other form of separation from the club / company, all kit and equipment must be promptly returned.

Failure to return club-owned items may result in legal action or withholding of any outstanding payments. We also reserve the right to notify Birmingham FA and other clubs, should the kit not be returned.

By adhering to this policy, we ensure the longevity and integrity of our club’s assets while maintaining accountability among our members.
